I picked B over D because I did not think that statement was a premise. I thought it was an illustration.

Well, two things could help here:
1. The statement is the reason that the author wants us to believe that legal responsibility depends (at least sometimes) on factors other than intentions. Thus, it is evidence for that claim.
2. This argument never makes the claim that "the criteria of legal responsibility ... include .. those for moral responsibility." Thus, even if the statement were an illustration, (B) incorrectly states what it's an illustration of.
