I got tripped up on what I interpreted as a semantic error in the answer choices. I chose (E) because the passage talks about principles of justice "within a particular state" and (E) mentions two societies which could be in the same state whereas (D) talks about two different states. Was my focus on semantics misguided?

Yeah, the word "state" is used in the passage to mean "sovereign entity." So the point of the argument is about the difference in social policies between any two sovereigns. Those could be two US states, or two provinces, two countries, two counties, etc.
Clearer?
